At Clarity Counseling, we believe transparency and client empowerment are essential to quality mental health care. This page outlines your rights regarding access to records, professional oversight, and consumer concerns.

This notice is provided in accordance with HIPAA, Texas House Bill 4224 (89th Regular Session), and Section 181.105 of the Texas Health and Safety Code.

Access to Your Medical Records

You have the right to request a copy of your mental health or clinical records for personal use or to authorize their release to another provider or entity.

Current Clients
Please submit requests through your secure client portal.

Former Clients
If you no longer have portal access, contact our office by email or phone and include:

  • Full legal name

  • Date of birth

  • Description of the records requested

Identity verification may be required.

Response Time

  • Requests are typically acknowledged within 24 business hours

  • Records are processed as promptly as possible and no later than 15 business days after receipt

  • If the office is closed for holidays or scheduled time off, response timelines will be communicated via auto-reply

Limitations on Access
In certain situations, the law may limit what records can be released, or disclosure may not be clinically appropriate. If a request cannot be fulfilled, you will receive written notice and, when possible, an alternative such as a summary of care.

Fees
A reasonable administrative fee (up to $25) may apply for requests involving extensive documentation.

Consumer Complaints

If you have concerns related to business practices rather than clinical care, you may file a consumer complaint with the Texas Office of the Attorney General – Consumer Protection Division through their online portal.

This process does not address concerns related to professional licensure or clinical conduct.
